User Agreement

This User Agreement ("Agreement") is a binding contract between you and TechBench ("TechBench", "we", "us"), an online learning service operated by an individual trader based in Italy. By creating an account or making a purchase, you confirm that you have read, understood, and agreed to this Agreement in full.

If you do not agree, do not create an account or make a purchase.

1. Who we are

TechBench is an online IT career progression platform operated by an individual trader under Italian law. The service is accessible at app.techbench.it. For any queries, contact us at hello@techbench.it.

2. Eligibility

You must be at least 18 years old to create an account and make a purchase. By registering, you confirm that you meet this requirement and that all information you provide is accurate and current. TechBench is a consumer-facing service — accounts are for personal use only, not for resale or redistribution of content.

3. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@techbench.it if you become aware of any unauthorised access.

One account per person. You may not share, sell, or transfer your account to another person. You may not use another person's account.

We reserve the right to suspend or terminate accounts that violate this Agreement, are used fraudulently, or are inactive for an extended period following written notice.

4. The service

TechBench provides structured IT career learning content organised across tiers and career specialisation trees. Access to content is gated by an active subscription. The content available to you at any time depends on your current subscription tier and any additional unlocks you have purchased.

We may update, revise, or remove individual lessons, modules, or features as the platform evolves. We will not remove substantial portions of content that you have paid to access without providing reasonable notice and, where appropriate, a proportionate remedy.

5. Subscriptions and access

The access rule. An active subscription gives you access to everything you have unlocked. Pausing or cancelling your subscription suspends all access. Resubscribing restores it immediately. Nothing is lost.

Subscriptions are billed monthly. Payment is processed by Stripe on your billing date. If payment fails, access is suspended until a successful payment is made. We will notify you of failed payments by email.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You retain access until that date. After the period ends, your account, progress, certificates, and unlocks are preserved — access is simply suspended until you resubscribe.

You may pause your subscription if that option is made available. Pausing suspends billing and access simultaneously. Resuming restores both.

6. Tier progression — one-way rule

Progression is one-way. Once you access a higher tier, you cannot revert to a lower tier. Your subscription price reflects the highest tier you have reached, not your current activity.

TechBench operates a one-way tier progression model. The four tiers are: Foundation (Tier 1), Entry Level (Tier 2), Mid-Level (Tier 3), and Senior (Tier 4). Each tier unlocks progressively advanced content. Once you have accessed a tier, that tier becomes your permanent subscription level — you will not be billed at a lower rate in future billing periods, regardless of which tier's content you are actively using.

This model reflects the nature of the content: progression through tiers represents real career development, and the pricing reflects the value of the level you have reached.

7. Branch unlocks

Career specialisation trees (Infrastructure, ITSM, Cloud, Security, Data & Analytics) beyond your primary tree may be unlocked via a one-time branch unlock fee. The branch unlock fee is a one-time payment that grants permanent access to that tree's content across all tiers, subject to your active subscription.

Branch unlocks are non-refundable once purchased, as content access begins immediately upon payment. See the Refund Policy for full details.

A branch unlock does not change your subscription price. Your subscription price is determined solely by your highest tier reached.

8. Software and certification packages

Software packages and certification preparation packages are optional one-time purchases that unlock specific additional content modules. These unlocks are permanent and associated with your account. Access to unlocked packages is gated by an active subscription — if your subscription lapses, package content is suspended alongside all other content and restored when you resubscribe.

Certification preparation content is designed to help you study for third-party examinations. TechBench is not affiliated with, endorsed by, or authorised by any certification body. Passing an examination is not guaranteed. See the copyright disclaimer within each certification module.

9. Digital content and the cooling-off waiver

Under EU consumer law (Directive 2011/83/EU), consumers ordinarily have a 14-day right to withdraw from distance contracts. However, this right does not apply to digital content that has been delivered and where the consumer has given prior express consent to delivery beginning before the end of the withdrawal period and acknowledged the loss of the right to withdraw.

At the point of purchase, you are presented with an explicit acknowledgement that content delivery begins immediately upon payment and that you thereby waive your right to withdraw. By completing a purchase after giving that acknowledgement, you confirm your consent. No refunds are available once content access has begun, except as required by applicable law or as set out in our Refund Policy.

10. Intellectual property

All content on TechBench — including lesson text, scenarios, quizzes, reference materials, and structural design — is the intellectual property of TechBench. You are granted a personal, non-exclusive, non-transferable licence to access and use the content for your own learning and career development. You may not reproduce, redistribute, republish, sell, or create derivative works from TechBench content without our prior written consent.

You retain all rights to any notes, responses, or work product you create while using the platform. By submitting feedback or suggestions, you grant us a perpetual, royalty-free licence to use that feedback to improve the service.

11. Certificates and credentials

TechBench issues certificates of completion upon satisfying defined criteria (completing all required lessons and passing the relevant capstone assessment). Certificates are issued to your account and associated with your name as it appears in your profile at the time of issue. The name on a certificate is not updated if you later change your display name.

TechBench certificates are platform-issued credentials that attest to completion of TechBench content. They are not regulated qualifications and carry no legal professional status. Their value is determined by employer recognition.

13. Availability and changes to the service

We aim to maintain the platform available at all times but do not guarantee uninterrupted access. Maintenance, updates, or circumstances beyond our control may cause temporary unavailability. We will aim to carry out planned maintenance outside peak hours and to give reasonable advance notice.

We reserve the right to modify, suspend, or discontinue the service or any part of it. If we make a material change that significantly reduces the value of your active subscription, we will notify you in advance and offer a proportionate remedy, which may include a subscription credit or prorated refund for the affected period.

14. Limitation of liability

To the fullest extent permitted by applicable EU consumer law, TechBench's liability to you for any claim arising from or related to this Agreement or your use of the service is limited to the total amount you have paid to TechBench in the twelve months preceding the claim.

TechBench is not liable for: indirect, incidental, or consequential losses; loss of career opportunity, employment, or income; or the outcome of any third-party examination or application process.

Nothing in this Agreement limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable EU law.

15. Governing law and disputes

This Agreement is governed by EU consumer law as applicable in your country of residence. Where EU harmonised rules apply, those rules take precedence. For matters not covered by EU harmonised rules, Italian law applies as the law of the country of establishment of the service provider.

If you have a complaint, please contact us first at hello@techbench.it. We will respond within 14 days and will make every reasonable effort to resolve the matter informally. If we are unable to resolve a dispute, you have the right to seek recourse through your national consumer protection authority or, where applicable, through the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Changes to this Agreement

We may update this Agreement from time to time. When we do, we will update the version date at the top of this page and notify active subscribers by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the revised Agreement. If you do not accept the changes, you may cancel your subscription before the effective date.
